The Union, as an area of freedom, security and justice, shall ensure that persons are not checked when crossing internal borders, and shall develop a common policy on asylum, immigration and external border control, based on solidarity and fair sharing of responsibility between Member States. This policy shall be fair towards third-country nationals and stateless persons, and shall be in compliance with international law and Union law, including fundamental rights.
